These Terms of Service (“Terms”) govern your use of PowerOf10.biz and the KonX platform operated by VtexCom Global, Inc. (“VtexCom,” “we,” “us,” or “our”). By accessing or using our services, you agree to these Terms. If you do not agree, do not use the services.

1. Eligibility and Accounts

1. You must be at least 18 years of age and legally capable of entering into binding agreements.
2. When enrolling as a Sales Agent, Team Agent, or Team Leader, you are doing so as an Independent Contractor, not an employee of VtexCom Global, Inc.
3. You are responsible for maintaining the security of your login credentials and are liable for any activity under your account.

2. Services and Access

4. PowerOf10.biz provides access to income-generating tools, including KonX Packs and eCard Packs, and other digital tools. Access is granted upon successful enrollment and payment.
5. Some features may be limited to active subscribers or paying users only. Services are subject to modification without notice.

3. Non-Refundable Policy

6. All sales are final. No refunds, credits, or exchanges will be provided under any circumstances.
7. This includes KonX Packs, eCard Packs, activation fees, and any subscriptions or upgrades.
8. Chargebacks or unauthorized reversals will result in account termination and collection actions with a 20% collection fee added.

4. Acceptable Use

9. You agree not to use the Services for unlawful, fraudulent, harassing, or harmful purposes.
10. Use of KonX or PowerOf10 for adult content, illegal product sales, or unapproved marketing is strictly prohibited and will lead to immediate termination.

5. Intellectual Property

11. All KonX software, materials, and content are the intellectual property of VtexCom Global, Inc. and protected by law.
12. You may not copy, reproduce, reverse-engineer, or republish any content without explicit permission.

6. Independent Contractor Relationship

13. You operate as an independent businessperson and are responsible for your own taxes, business filings, and legal compliance.
14. This agreement does not establish any employment or agency relationship between you and VtexCom Global, Inc.

7. Earnings Disclaimer

15. PowerOf10.biz provides tools and opportunities for income, but we make no guarantees of earnings. Success depends on your personal effort and business activity.

8. Privacy

16. Your personal data is handled according to our Privacy Policy (link to be added). We implement reasonable security measures but cannot guarantee complete protection.

9. Modifications to Terms

17. We may update these Terms at any time. Continued use of our Services constitutes your agreement to the revised Terms.

10. Termination

18. We reserve the right to terminate or suspend your account at our discretion if you violate these Terms.
19. Upon termination, you lose access to the Services and forfeit any pending commissions or access to your account data.

11. Limitation of Liability

20. VtexCom Global, Inc. is not liable for indirect, incidental, or consequential damages of any kind.
21. Our total liability for any claims will not exceed the amount you paid for Services in the prior 12 months.

12. Governing Law and Arbitration

22. These Terms are governed by the laws of the State of Nevada, USA. Disputes shall be resolved via binding arbitration in Las Vegas, Nevada unless otherwise provided by applicable state law (e.g., Louisiana residents may choose Louisiana law and venue).
